Free and low-cost divorce help in West Virginia

There is no public defender for a divorce in West Virginia, or anywhere else — the right to a free lawyer is a criminal-case right, and a divorce is a civil case. What exists instead is on this page, with the link to each one. Start with the fee waiver and the question of whether your spouse can be made to pay your legal fees, because those two are the ones people never think to ask about.

The five things to try, in this order

Ordered by how much they are worth relative to how hard they are, not alphabetically.

  1. Ask about the filing fee waiver. In West Virginia it is called Fee Waiver (Affidavit of Indigency). Available to those receiving certain government benefits (e.g., WV Works, SSI) or with low income; if the clerk approves the waiver form, the filer does not pay the filing fee. Statewide base divorce filing fee cited elsewhere as $135 under W. Va. Code sec. 59-1-11(a)(3) (not independently confirmed against the primary statute text.
  2. Ask whether your spouse can be ordered to pay your lawyer. Court may award attorney’s fees and court costs reasonably necessary to allow either party to prosecute or defend the divorce action, per WomensLaw.org’s summary of West Virginia divorce law (citing this section alongside Gallagher v. Gallagher, 147 W.Va. 463 (1971)); primary code text not independently re-verified on the state legislature’s own site. (W. Va. Code sec. 48-5-208)
  3. Check the statewide legal-aid portal. Legal Aid of West Virginia (legalaidwv.org) lists the program that covers your county and what it takes.
  4. Use the court self-help service. West Virginia Judiciary Fee Waiver Forms / Legal Aid WV Guided Self Help. Fee waiver forms usable in Magistrate, Circuit, or Family Court, per the Supreme Court’s Administrative Order and Financial Guidelines; Legal Aid WV separately hosts guided interview forms to prepare divorce/custody-modification paperwork.
  5. Try the bar referral service. West Virginia State Bar Lawyer Referral Service (LRS). Legal aid in West Virginia

Legal aid organizations are funded to serve people under an income threshold, and family cases are one of the areas they most often take. Being turned down by one is not the end of it — the threshold, the caseload and the priorities differ by program and by month.

WVU College of Law Clinical Law Program. Clinics are free, supervised by faculty, and the students have far more time for your case than a stretched legal aid lawyer does. They take few cases and they follow the academic year, so the answer depends heavily on when you ask.

Worth knowing about West Virginia
